§ 10.48.030. Prohibitions.

  • A.

    Within Lot No. 1, Lot No. 2, Lot No. 3 and Lot No. 4, no person shall:

    1.

    Park or stand a vehicle in any driveway;

    2.

    Park or stand a vehicle on a crosswalk or walkway;

    3.

    Park or stand a vehicle on a center island or dividing strip;

    4.

    Park or stand a vehicle on any grass area or planted strip;

    5.

    Park or stand a vehicle in any entrance or exit;

    6.

    Park a vehicle in any manner other than headed into and facing a center island or dividing strip, when occupying an interior parking space, or facing the outside boundary of the parking lot when occupying an exterior parking space;

    7.

    Park or stand a vehicle in any manner so as to block or impede vehicular progress or access to or exit from a parking space;

    8.

    Park a vehicle between the hours of two a.m. and five a.m.;

    9.

    Operate a vehicle for a purpose other than commuter parking or standing to discharge or pickup commuters, except as to Lot No. 4;

    10.

    Disobey a direction or signal given by a police officer or violate a police rule or regulation promulgated for the use of the parking lot;

    11.

    Park between the hours of six a.m. and six p.m. Monday through Friday, except legal holidays, without first having obtained the proper permit and affixed the same to the vehicle in the manner prescribed by rules and regulations of the police department;

    12.

    Place, store, keep or accumulate outside any vehicle any chattels, goods, wares, merchandise, garbage, refuse, debris or other waste of any kind;

    13.

    Deface, damage or impair the usefulness of any public property or improvement;

    14.

    The most easterly entrance to Lot No. 1, located on Park Avenue nearest Plainfield Avenue, shall not be used as an exit. The direction of travel for vehicles entering such entrance shall be one-way westbound until the intersection of the driveway on the westerly side of the engineering building;

    15.

    The most westerly entrance to Lot No. 1, located on Park Avenue nearest the municipal building, shall be used only by police vehicles, police department members and visitors to the police department;

    16.

    No parking is permitted in the area adjacent to the passenger waiting platform on the northerly side of the Erie-Lackawanna Railroad tracks, such area to be used only for the pickup and discharge of passengers;

    17.

    No overnight parking shall be permitted except with permission from the police department in cases of emergency and such times when snow-plowing operations are not required. Any vehicle parking overnight in violation of this provision will be towed away at the owner's expense.

    B.

    The following shall apply to the free public library parking lot:

    1.

    No person shall:

    a.

    Park vehicles in nondesignated areas;

    b.

    Park or stand a vehicle in any driveway;

    c.

    Park or stand a vehicle on a crosswalk or walkway;

    d.

    Park or stand a vehicle on any grass area or planted strip.

    2.

    Use of the parking lot as a turn-around is prohibited.

    3.

    Vehicular traffic through the parking lot, not related to the use of the library is prohibited.

    4.

    All ordinances of the Township of Berkeley Heights that are inconsistent with the provisions of the ordinance codified in this chapter are repealed to the extent of such inconsistency.

    5.

    If any section, subsection, clause or phrase of this chapter is, for any reason, held to be unconstitutional or invalid, such decision shall not effect the remaining portion of this chapter.

    6.

    The ordinance codified in this chapter shall take effect immediately after final hearing and publication according to law.
